Terms of Service

Effective date: 21 September 2026. Version: 2026-09. Contract language: English.

1. Who operates Skretchy

The Skretchy mobile application and its related services (together, the “Service”) are operated by Matolcsi Jákob, a sole proprietor registered in Hungary (Hungarian registered designation: Matolcsi Jákob egyéni vállalkozó). In these Terms, “we”, “us” and “our” refer to that sole proprietor, and “you” refers to the individual using the Service.

To email us, replace [at] with @ and [dot] with a full stop, and remove the spaces. To call us, dial the telephone number without the spaces or slashes, retaining the +36 country code.

These Terms of Service (“Terms”) govern your contractual relationship with us. The Community Rules in section 6 form part of these Terms.

Our Privacy Policy separately explains how we process personal data. Reading or acknowledging that policy does not constitute blanket consent to all processing activities.

2. The Service and eligibility

Skretchy lets friends share photos, captions and drawings as virtual scratch cards, and exchange text messages. Discovery helps you find friends of friends. Adding a profile photo and using Discovery are optional; you can send cards to friends without either feature.

You must be at least 18 years old to use the Service. After signing in, you must separately confirm that you meet this age requirement before proceeding. Making a false declaration or bypassing the age restriction breaches these Terms.

The initial public release is offered in the member states of the European Union through the Apple App Store. You need a supported iOS device, an internet connection and an account. The App Store listing specifies the current system requirements. Sign-in uses Sign in with Apple.

You must take reasonable steps to protect your account access and device. You must not transfer your account to another person or impersonate someone else. Please notify us without undue delay if you become aware of unauthorised access or a security issue.

3. How the contract is formed

The contract is concluded electronically for an indefinite period. During the sign-in process, you can review the linked documents, confirm that you meet the age requirement, accept these Terms and submit your declarations using the continue button. Once they have been recorded successfully, the app allows you to proceed. You can change the selections before submitting them.

We record the accepted Terms version, the time of acceptance and the time of your age declaration against your account. No separate signed contract document is created. You can request information about these records using the email address in section 1. These Terms are available on our Terms page.

The language of the contract is English. The Service and its legal documents are initially provided in English. Additional translations may be introduced later.

4. Free access and virtual diamonds

The Service is currently free of charge. Any charges for your device or internet connection are payable under your arrangements with the relevant provider.

Diamonds are virtual points used solely within the app. They cannot be purchased with real money or redeemed for money, and do not give you an investment interest or an entitlement to a cash prize. Unlocking gives you access to a photo card's content. The app explains how diamonds are earned and used, and shows the conditions for an unlock before you carry it out.

We may make a justified correction to an incorrect balance resulting from established abuse or a technical error. You can request a review of the correction by emailing us at the address in section 1.

We will introduce any paid service only after providing separate advance information and obtaining any declarations required to enter into the relevant contract. Free access does not limit consumer rights that apply by law.

5. Your content and the permission you give us

Ownership of copyright and other rights in uploaded content does not change. You may upload or share only content you are entitled to use, and must respect other people's privacy, image rights, copyright and other rights. You must obtain any consent required to use another person's image unless an applicable legal exception permits that use. Being friends with someone does not, by itself, give permission to share their image.

By uploading content, you grant us a non-exclusive, royalty-free licence limited to what is necessary to provide the Service. This covers storing, making technical copies of, resizing, converting, transmitting and displaying the content to authorised recipients. It also covers displaying your profile according to your chosen visibility settings. We may involve our infrastructure providers only for these purposes and to the extent necessary.

The scope and duration of this permission are limited by the service purpose, your settings and any lawful retention requirements. It does not allow us to sell your content, use it for advertising or train artificial intelligence models on it. This licence does not replace the need for a lawful basis to process personal data.

The scratch-off covering is a visual feature, not end-to-end encryption. Recipients can take screenshots or make copies. Withdrawing a card, its expiry or deleting your account cannot remove independent copies saved on someone else's device.

6. Community Rules

You must not upload, send or use in your profile any content, or engage in conduct, that:

These rules apply to private cards and messages as well as profile photos, display names and usernames.

Reports must be made in good faith. A report that turns out to be unfounded is not, by itself, abuse. Deliberately false reports or reports made to harass someone may justify restrictions, depending on the circumstances.

7. Reporting, blocking and moderation

You can report a card or a user using Report in the app. To report an objectionable text message, report the relevant user and provide enough context to identify the message. Using Block removes the shared conversation from both users' screens and prevents further sending within that blocked relationship. You can leave the official Skretchy account's conversation using Leave.

You can also report an issue without an account using the email address in section 1 or the support page. That address is also our contact point for users and competent authorities in any EU member state; you can contact us in English or Hungarian and receive a response from the operator. Please identify the content, provide the information needed to locate it, explain your concern and include contact details for a response. Please also confirm that the information is accurate and complete to the best of your knowledge. We do not ask you to resend unlawful images. For an immediate threat to life, contact the emergency services; in Hungary and elsewhere in the EU, you can call 112.

Profile photos and other user content are not subject to prior human content review. A profile photo can become visible to authorised users as soon as it is uploaded. We review reports with human involvement and record a reference to the profile photo in use when a user is reported. Our Privacy Policy explains evidence retention.

Where content or conduct is unlawful or breaches these Terms, we may take proportionate action. This can include a warning, restricting access to or removing content, temporarily restricting an account or terminating the contract in serious or repeated cases. We consider the nature and severity of the issue, the people affected and whether the conduct has been repeated. An urgent threat or a binding legal requirement may require action without a prior warning.

We will inform the affected user of the decision, its reasons and how to request a review, unless a legal requirement or binding order prevents disclosure. We do not disclose the reporter's identity to the reported user; responding to a lawful request from an authority is a separate matter. We examine reports without undue delay and prioritise urgent cases.

You can request a review by emailing the address in section 1. The operator conducts the review; there is no separate independent internal review body. This process does not limit access to a court, a competent authority or any other remedy available by law.

8. Ending the contract and deleting your account

You can end the contract at any time, without giving a reason or paying a fee, by deleting your account from the Profile screen or sending a termination request to the email address in section 1. For an email request, we may ask for proportionate confirmation that you control the account.

Our Privacy Policy explains the effects of account deletion, including the treatment of shared files and records that must be retained lawfully after deletion. Any virtual balance that ends with the account does not entitle you to a cash payment.

The ability to end the contract at any time does not replace or restrict any statutory right to withdraw, terminate or seek a remedy for a failure to supply the Service in conformity with the contract. Accepting these Terms does not waive those rights.

Fourteen-day withdrawal period. As a consumer, you may withdraw from this contract without giving a reason within 14 days after it is concluded. If provision of the Service has already started, you may terminate it within the same period. Starting to use the app does not waive this right. No payment is due for exercising it or for the free Service already supplied.

Send a clear statement of your decision to the email or postal address in section 1 before the period expires. You may use the optional form below, but you do not have to. Keep a copy of your notice and evidence of when you sent it. Any longer period required by mandatory law remains available.

Optional withdrawal/termination form

If you wish to retrieve content in connection with ending the contract, contact us before deleting your account so we can arrange the request before its removal. Where consumer law gives you a right to retrieve non-personal content you supplied or created, we will provide it free of charge, within a reasonable time and in a commonly used, machine-readable format, subject to the statutory exceptions. Your GDPR rights concerning personal data apply separately. This request procedure does not restrict any statutory retrieval right.

9. Changes and discontinuation

We may change the Service to comply with law, address a security issue or abuse, maintain compatibility with supported systems, or improve its functionality or accessibility. Changes beyond those needed to maintain conformity must have a valid reason of this kind, be made without additional cost and be explained clearly.

We will give you clear advance notice of material changes to these Terms or the Service, their reasons and when they take effect. If a change adversely affects access or use beyond a minor degree, we will inform you reasonably in advance on a durable medium, such as an email you can retain, about the change and your rights. You may terminate free of charge within 30 days after receiving that notice or the change taking effect, whichever is later. This does not limit your broader right to end the contract at any time.

The app asks you to accept a new Terms version before further use. Changes do not apply retrospectively. If you do not accept the new Terms, you can end the contract free of charge and exercise your data protection rights outside the app. We will inform you about urgent security measures or mandatory legal changes as soon as the circumstances allow.

If we plan to discontinue the Service, we will notify you in advance and make available any data or content we are required by law to provide. Discontinuation does not affect accrued claims or mandatory consumer rights.

10. Service issues and liability

We investigate reported faults and take reasonable steps to restore the Service's intended operation. Maintenance and technical incidents can cause temporary interruptions; this does not, by itself, exclude any valid claim you may have.

The Service must meet the applicable contractual and statutory requirements throughout its supply. We will provide, and inform you about, updates including security updates necessary to maintain conformity during that period. Please install those updates within a reasonable time after they become available.

If the Service is not supplied, you may ask us to supply it without undue delay or within an additional period expressly agreed with us. You may terminate if we fail to do so. No further opportunity is required where we have refused supply or timely supply was essential in the circumstances recognised by law.

For a defect, you may require us to bring the Service into conformity free of charge, within a reasonable time and without significant inconvenience. You may terminate where correction is impossible or disproportionate, we fail or refuse to correct it, the defect recurs, or it is serious enough to justify immediate termination. These remedies are additional to your right to end the free Service at any time. There is no subscription price to reduce or refund; any other mandatory remedy remains available.

Our liability is governed by applicable law. These Terms do not exclude or limit liability that cannot lawfully be excluded or limited, or any mandatory consumer rights, including statutory remedies for non-conforming performance.

11. Complaints and disputes

You can submit a complaint using the contact details in section 1. We examine oral complaints promptly and resolve them where necessary. If an immediate investigation is not possible, or you disagree with how the complaint is handled, we prepare a written record and give or send you a copy as required by law.

We provide a substantive written response to written complaints within 30 days of receipt, in a manner that can be evidenced, unless the law specifies a different deadline. We give reasons if we reject a complaint. We retain the written complaint or record of an oral complaint, and a copy of our substantive response, for three years.

If we reject a complaint, our response includes information about the available remedies and the contact details of the relevant authority or conciliation body. For a consumer dispute, you can contact the conciliation body competent for your place of residence or stay. We cooperate with the procedure as required by law.

The following regional conciliation bodies cover Hungary. Their Hungarian names link to their official websites. Addresses are in Hungary; a separate postal address is given where published. Contact the relevant body for its current appointment and filing arrangements.

The Pest body currently accepts applications through its online filing service, by post or through its official electronic gateway, rather than by email. Check its linked website for the filing form.

We have not made a general declaration accepting binding conciliation decisions (an “általános alávetési nyilatkozat”). This does not affect our statutory duty to cooperate or a conciliation body's power to issue a binding decision where the law permits it.

For a cross-border consumer dispute within the EU, you can also ask the European Consumer Centre in your country for assistance through ECC-Net. This does not require you to use only Hungarian complaint channels.

Hungarian law governs these Terms. This choice does not deprive you of protection under mandatory consumer laws that would otherwise apply to you. You may also bring a claim before a court with jurisdiction under the applicable rules.
